Terms of Service

The KEPTPRIVATE service (the "Service"), owned by KEPTPRIVATE, INC., is provided to you ("User") under the terms and conditions of this KEPTPRIVATE Terms of Service and any amendments thereto and any operating rules or policies that may be published from time to time by KEPTPRIVATE. The TERMS OF SERVICE comprises the entire agreement between User and KEPTPRIVATE and supersedes any prior agreements pertaining to the subject matter contained herein. The KEPTPRIVATE service is provided to individuals who are at least 18 years old or to minors who have parental consent to open and maintain an account. BY COMPLETING THE ACCOUNT CREATION PROCESS AND CLICKING THE "ACCEPT" BUTTON, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF SERVICE.

CONDUCT OF SUBSCRIBER

You agree not to use the service for illegal purposes or for the transmission of material that is unlawful, harassing, libelous, invasive of another's privacy, abusive, threatening, harmful, vulgar, obscene, tortuous, or otherwise objectionable, or that infringes or may infringe the intellectual property or other rights of another.

You agree that KEPTPRIVATE, Its EMPLOYEES and their designees may in their sole discretion terminate your account if they believe you have in any way violated the Terms of Service.

You agree to be bound by Internet regulations, policies and procedures. We're an Internet-based business and we use the Internet to send and receive certain types of communications.

You agree to comply with all applicable local, state, national and international laws and regulations. You also agree to not use your KEPTPRIVATE account for illegal purposes; to not interfere or disrupt networks connected to this service; and to comply with all the rules, policies and procedures connected to this service.

You will not use your KEPTPRIVATE account to send junk email, spam, chain letters or use email lists that contain any person that has not specifically agreed to be included on that list.

You agree not to transmit, or allow others to use your address to transmit, through your KEPTPRIVATE account, any objectionable material including, but not limited to, unlawful or harassing, libelous, abusive, threatening, harmful, obscene material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate items mentioned.

You are responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of KEPTPRIVATE and all charges related thereto.

You hereby acknowledge that the provisions of this section shall apply to all uses of KEPTPRIVATE.

Each user will create a password and account designation upon completing the subscription process. User is responsible for maintaining the confidentiality of the password and account, and is fully responsible for all activities that occur under User's password or account. User agrees to immediately notify KEPTPRIVATE of any unauthorized use of User's password or account or any other breach of security.

ACCOUNT TERMINATION

User agrees that KEPTPRIVATE or its EMPLOYEES may terminate User's password, account or use of the Service if KEPTPRIVATE or its EMPLOYEES believe that User has violated or acted inconsistently with the letter or spirit of the TERMS OF SERVICE, or that User has violated the rights of KEPTPRIVATE or its EMPLOYEES or other Users or parties.

KEPTPRIVATE may terminate your access to the Service and any related service (s) at any time, with or without cause, with or without notice, effective immediately, for any reason whatsoever. KEPTPRIVATE has no obligation to store or forward the contents of your account

User agrees not to resell the Service or use of or access to the Service. If suspected your account will be terminated.

Our spam policy at KEPTPRIVATE is "zero-tolerance". Anyone found to be generating spam from within our system will have their user privileges revoked immediately. Persons attempting to forward spam email messages inbound to our system will be blocked and prevented from sending further email to any KEPTPRIVATE users.

EMAIL STORAGE AND SENDING LIMITATIONS

KEPTPRIVATE and its EMPLOYEES assume no responsibility for the deletion or failure to store email messages. KEPTPRIVATE will not allow message storage to exceed thirty (100) megabytes for any individual User. KEPTPRIVATE will not send or receive any message larger than eight (8) megabytes, including any attachments. KEPTPRIVATE will not send any message addressed to more than twenty (20) recipients total, including To:, Cc:, and Bcc: fields.

The amount of email storage space per member is limited. Some email messages may not be processed due to space constraints or outbound message limitations. You agree that KEPTPRIVATE is not responsible or liable for the deletion or failure to store messages or other information.

LIABILITY LIMITATIONS

User further agrees that KEPTPRIVATE and its employees shall not be liable for any damages arising from interruption, suspension or termination of service

User agrees that KEPTPRIVATE and its employees shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use the service or for cost of procurement of substitute goods and services or resulting from any good or services purchased or obtained or messages received or transactions entered into through or from the service or resulting from unauthorized access to or alteration of user?s transmissions or data, including but not limited to damages for loss of profits, use, data or other intangible, even if KEPTPRIVATE or its employees has been advised of the possibility of such damages.

Keptprivate.com has no liability to you for any damages, losses and causes of action.

GENERAL

The information and services included in or available through the Service may include inaccuracies or errors. KEPTPRIVATE may make changes and/or improvements to the Service at any time without notice.

KEPTPRIVATE does not guarantee that KEPTPRIVATE will be uninterrupted or error-free, that bugs or malfunctions will be corrected, or that the Service and its servers are free of harmful components.

KEPTPRIVATE owns and operates this Web site and has the right at any time to change or discontinue any aspect of the Web site or service, including the content, hours of availability, and equipment needed for access to or use of KEPTPRIVATE. KEPTPRIVATE may at its discretion modify or prohibit the registration of any user ID or username

KEPTPRIVATE does not guarantee that the uses of its Service, or the materials provided within the Service, are accurate, without error, or reliable. KEPTPRIVATE does not guarantee that advertised features may ever materialize.

KEPTPRIVATE provides its Service "as is". The Company makes no warranty or covenant in regards to the availability, reliability, or timeliness of the Service. KEPTPRIVATE is not responsible for the appropriateness of the Service for any one purpose.

KEPTPRIVATE will not be held responsible for any and all damages whatsoever as a result of the loss of use, data or profits connected to the performance of your KEPTPRIVATE account. The user is solely responsible for any and all information that passes through the KEPTPRIVATE servers. KEPTPRIVATE is not responsible or liable for any product or service acquired or requested using the Service. The sole remedy is for users to discontinue their use of KEPTPRIVATE and its related Web sites.

KEPTPRIVATE considers email transmitted via the Service to be the private correspondence between the sender and recipient. KEPTPRIVATE does not monitor, edit or disclose the contents of a User's private communications, under any circumstances, nor do we log traffic, IP addresses, or anything other than very limited server error messages.

You agree that KEPTPRIVATE, its parents, subsidiaries, officers and employees, cannot be held responsible for any third party claim, demand, or damage, including reasonable attorneys' fees, arising out of your use of the Service.

KEPTPRIVATE and Its EMPLOYEES are not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

REFUND POLICY

If the subscriber is dissatisfied with the KEPTPRIVATE service for any reason within 30 days of the initial account creation the account will be closed and a full refund will be issued.

NOTICE AND MODIFICATIONS

KEPTPRIVATE reserves the right to review and change this agreement regarding the use of the Service at any time. User agrees that KEPTPRIVATE and its EMPLOYEES shall not be liable to User or any third party for any modification of the Service.

Any notice to User or to the Service shall be made via email. The Service may also provide notices of changes to the TERMS OF SERVICE or other matters by displaying notices to Users generally on the Service.
